Court Grants Temporary Restraining Order Against Randy and Tara Schroeder

October 18, 2008

A Temporary Restraining Order (TRO) will be entered against Defendants Randy Schroeder, Tara Schroeder, and Rising Sun, Inc., by the United States District Court in Utah following a hearing on October 16, 2008. Agel had requested that the Court prevent former distributors from using Agel'€™s trademarks, web sites, confidential lists and contact information to compete against Agel. The court stated that it will be entering a TRO.

Agel filed a lawsuit against Randy and Tara Schroeder alleging that they had violated various state and federal laws. In the TRO hearing, the Court ruled that Agel had established that there was a substantial likelihood of success on the merits that Randy Schroeder may have used email addresses and names protected by Agel's agreement. The Court also found that there is irreparable harm to Agel if Randy Schroeder is permitted to continue the use of that confidential information.

More specifically, Judge Steward held:

The Court is going to issue a temporary restraining order prohibiting Mr. Schroeder from using e-mail communications, the names of those individuals that are protected by the confidential information and team member lists, section 5 of the policy.

The TRO will preclude the defendant from using any Web site that has Agel in it. And, further, he will be prohibited from any agreement with Yahoo, Google or any other search engine from using—from allowing or requiring them to direct traffic to his Web site or sites when someone types in the word Agel in the search engine.

This week, Agel filed numerous lawsuits against other former distributors alleging that they are improperly using Agel's confidential information relating to cross-recruiting. Over the next few weeks, Agel expects numerous and additional lawsuits to be filed. Agel will also request that the court enter Temporary Restraining Orders against each one of these defendants.

According to a statement released by Agel's General Counsel, Jesse L. Riddle, “If a distributor violates their contract and cross-recruits, they will be sued.

Agel has established a new email address so that our Team Members may report cross-recruiting or other violations of Agel's Policies and Procedures. It is lawsuits@agel.com.

If any Team Member receives any communication from Randy or Tara Schroeder, or anyone affiliated in any manner with Randy or Tara Schroeder, please send information immediately to lawsuits@agel.com.

Hello,

Just want to ask, why did you even post that restraining order? It has nothing to do with building the business with Agel, or any other business that you are in or I or Randy. Just business as usual and I am quite sure that Agel has enough legal advise to know what it is doing. None of us will ever know the whole truth as only the two parties involved know for sure. I feel it would be better to focus on the positive instead of a negative that we are not involved in, nor can we benefit from it and it sure doesn't help anyone else. I thought I was going to read about a business or how to advance with one I am in instead we are showing someone's laundry. Truth is Truth, and one thing you are right about it is time to move on.

Three points,

1. This post was over three months old until you two bumped it up to the top. So if you are both so adamant about leaving it alone, you would be best served by not responding to it. :roll:

2. Agel Corporate felt that it was necessary to broadcast this to it's entire field. That is where the content this post came from originally. Do you feel Agel was in error as well? :?:

3. This is an Agel forum. It is here to discuss Agel and news "about" Agel... This is news. :idea:

Granted this is news about Agel, but is it really what you would want your intended team members to view, what first impression will they receive of our business. I can understand Agel posting it to the field as well they should and we all in Agel received it. But I don't believe that Glen,Craig, Randy, or Eric wanted it to be the topic that everyone associates with Agel, this is not what Agel is all about and there are better topics to discuss about the business then when an Exec. team member decides to leave and what happens after or the way he left. Why not discuss the great training, friendships, or the Agel Cares Foundation,or the success you and I have found in this business. I would prefer to have positive flow being exposed on the internet /web instead of negatives. I understand it is a way to get people talking or getting the post to the top as you say, but I just started with betternet and was hoping to see great, good, as well as the positive about Agel as I have in other forums where we are all trying to help each other and build each other up, not airing out the laundry. Even though it is three months old it is and will still be read by a lot of the newbies on betternet like myself who typed in Agel and your one of the forums that comes up so of course we will click on it.
Just thought you would have preferred someone to come to you about helping them acheive in Agel instead of making them think that Agel has nouthing better to do then go after one of their exec. team members based on the fact that he is taking many of the group he sponsored or knew with him. Doesn't appear to be a stable company unless you know all the facts as we do who are in Agel.
What about the readers who just started with the company days ago or weeks ago or only a month ago, anyone with a brain as you well know will click on this just to see what it is all about. I clicked because I decided to check out all and any forums dealing with Agel here.But I am strong and stable and quite satisfied with Agel and have had good success as I am sure you have too. I hope you are not upset because some of us might not agree with you, I was under the impression that we were intitled to our own opinion just as you are. Wasn't trying to get you upset, just giving an opinion as a fellow Agel team member. This is my last post in this forum as I don't want to ruffle feathers and it seems I did.
